Terms of Service

1. Acceptance of terms

By creating an account, posting a listing, or otherwise using AfrikaFinds you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, you must not use the service.

2. Eligibility

You must be at least 18 years old to register, post listings or otherwise transact through AfrikaFinds. By using the service you represent that you are 18 years of age or older and have the legal capacity to enter into binding contracts.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate registration information and to keep it up to date. We may suspend or terminate accounts that contain false information or that are used in breach of these Terms.

4. Listings

AfrikaFinds is a venue for users to publish their own classified advertisements. We do not own, sell or warrant any of the items or services advertised. By posting a listing, you represent that:

• You own the item or have authority to sell or hire it.
• The listing is truthful, accurate and not misleading in any material respect.
• The listing complies with all applicable laws, regulations and these Terms.

4.1 Prohibited content

You may not post listings that include or relate to any of the following:

• Illegal goods, stolen property, or items whose sale is restricted in your country (including controlled drugs, illegal weapons, ammunition without the required permit, counterfeit goods).
• Live wildlife protected by law, ivory, rhino horn or other prohibited animal products.
• Explicit sexual content, pornography, sexual services, or any content of a sexually explicit nature.
• Scam listings, pyramid schemes, "get rich quick" schemes, multi-level marketing recruitment, or any deceptive offers.
• Content targeting, depicting or intended for minors in a sexual, exploitative or otherwise harmful context.
• Content that promotes hate speech, discrimination, harassment or violence against any individual or group.
• Personal data of third parties posted without their consent.
• Malware, phishing material, or links to malicious or fraudulent sites.

We reserve the right to remove any listing at our sole discretion and without notice, and to suspend or terminate accounts that violate this section.

4.2 Personals section

The Personals section is intended for adults (18 years and older) seeking companionship, friendship or dating connections. It is not a venue for sexual services, escorting, prostitution or any explicitly sexual content. Listings in this section that violate these restrictions will be removed and accounts may be permanently banned. Access to Personals requires confirming your age.

5. User conduct

You agree not to:

• Use AfrikaFinds for any unlawful purpose or in violation of any applicable law.
• Harass, threaten, defame or impersonate any other person or entity.
• Attempt to gain unauthorised access to other users' accounts, our systems, or any data not intended for you.
• Interfere with or disrupt the service, including by introducing malware, executing denial-of-service attacks, or scraping the site at a rate that degrades performance for others.
• Use bots, crawlers or automated tools to harvest contact information or listing data without our written permission.
• Post duplicate listings, spam, or content designed to manipulate search rankings.

6. Transactions between users

AfrikaFinds is only a venue connecting buyers and sellers. We are not a party to any transaction between users. We do not handle payments between buyers and sellers, do not verify the identity, accuracy or legality of users or listings, and do not guarantee the quality, safety or condition of items advertised.

You are solely responsible for evaluating the goods, services and counterparty before completing any transaction. We strongly recommend meeting in safe, public places, inspecting items before paying, and using secure payment methods. Any disputes arising from a transaction must be resolved directly between the parties.

7. Premium features and fees

Basic listings on AfrikaFinds are free. We may from time to time offer paid features such as featured placement, listing boosts, or extended visibility. Where fees apply, they will be clearly displayed before you commit to the purchase. All fees are non-refundable except where required by law or expressly stated otherwise.

8. Reporting and moderation

You can report suspicious listings, fraudulent users or content that violates these Terms by using the report functionality on the relevant listing or by emailing support@starlightgroupsa.co.za. We will review reports and may remove content or suspend accounts at our discretion.

9. Intellectual property

AfrikaFinds, the AfrikaFinds name, logo, design, source code and all related intellectual property are owned by Starlight Group SA (Pty) Ltd and are protected by applicable copyright, trade-mark and other laws. You may not copy, reproduce, distribute, modify or create derivative works of the platform or any of its content without our written permission.

You retain ownership of the content you upload (including listing text and photographs). By posting content on AfrikaFinds you grant us a worldwide, royalty-free, non-exclusive licence to host, display, reproduce and distribute that content for the purpose of operating, promoting and improving the service.

10. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, AfrikaFinds is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

To the maximum extent permitted by applicable law, neither Starlight Group SA (Pty) Ltd nor any of its directors, employees or agents shall be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenues, data or goodwill, arising out of or related to your use of the service, listings posted by other users, or any transaction conducted through the platform.

11. Indemnity

You agree to indemnify and hold harmless Starlight Group SA (Pty) Ltd, its directors, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to (a) your use of the service, (b) the content you post, (c) your breach of these Terms, or (d) your violation of any applicable law or third-party right.

12. Termination

We may suspend or terminate your account and access to the service at any time, with or without notice, if we reasonably believe you have breached these Terms or acted in a way that may harm us or other users. You may close your account at any time by following the instructions in your account settings or by contacting us.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Arbitration Foundation of Southern Africa ("AFSA"), in accordance with the AFSA rules. The seat of the arbitration shall be Johannesburg, South Africa, and the proceedings shall be conducted in English.

14. Language

These Terms are in English. We may make translations available for convenience. In the event of any conflict between the English version and a translated version, the English version shall prevail.

15. Changes to these terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Material changes will be notified to you by email or through a notice on the site. Your continued use of the service after the changes take effect constitutes your acceptance of the revised Terms.
